VARIABLES

1.1 The Competition is open to residents of Australia only, and who are at least 18 years of age.
1.2 Commencement time: 1:00pm Australian Eastern Standard Time (AEST).
1.3 Commencement date: Wednesday 5th February 2020
1.4 Closing time: 3:00pm AEST.
1.5 Closing date: Wednesday 26th February 2020
1.6 Draw time: 12:00pm AEST
1.7 Draw date: Thursday 27th February 2020

WHO MAY ENTER

The only persons who may enter into the competition and be awarded prizes are those people specified in Condition 1.1 and who are not (i) employees of, or contractors to, the Promoter or any of its agencies involved with this competition; or (ii) members of the immediate family of such employees and contractors, including any spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee or /contractor. The competition is not open to persons under the age of 18. Persons must reside within Australia.


HOW TO ENTER

To enter the promotion entrant needs to enter the required details in to the ‘WIN $500 WORTH OF TEVA SHOES’ entry form (including their first name, surname, date of birth, mobile, post code, email, gender) then accept the terms and conditions of entry and submit entry into the draw. This entry form can be found via au.teva.com.

Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction, including any telephone, telephone or computer network, telephone lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.


LIMITATIONS ON ENTRY

One entry allowed per person (identified by email). Multiple entries per household are allowed. Persons wishing to enter must comply with condition 1.1.


DURATION

The competition commences at the time specified in Condition 1.2 on the date specified in Condition 1.3. Entries must be received by the time specified in Condition 1.4 on the date specified in Condition 1.5.


SELECTION OF WINNERS

There will be two (2) winners drawn from the total entrant database at the time specified in condition 1.6 on the date specified in condition 1.7, and will be conducted at the location specified in condition 1.8. The first valid entry as per condition 1.1 drawn will win the prize. The ‘WIN $500 WORTH OF TEVA SHOES’ competition is a game of chance, thus skill plays no part in determining the winners. Each entry has a random and equal chance of being drawn. All entries received during the promotion period will be entered into the draw. The Promoter retains the absolute discretion to require any entrant to provide proof of Australian residency at the Household address shown on their entry before awarding a prize.

The Promoter reserves the right to verify the validity of entries at any time during or after the promotional period, and reserves the right to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions.

To the extent permitted by law, the Promoter is not responsible or liable for: (a.) inaccurate / incorrect transcription of entry information; (b.) purported entries that are not received for any reason, including because they were incorrectly uploaded or misdirected, or that are received, but are late, illegible, incomplete, or sent other than as directed in the entry instructions; (c.) unauthorised human intervention in any part of the competition; (d.) electronic or human error which may occur in the administration of the competition; (e.) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner; or (f.) any technical difficulties or equipment malfunction (whether or not under either Promoter’s control); (g.) any theft, unauthorised access or third party interference.

Promoter’s decision is final and no correspondence will be entered into.


WINNERS NOTIFICATION, PUBLICATION AND REDRAW

The winners will be notified via email within 120 hours after the draw. They will be contacted via the email address which was entered into the competition. Despite the Promoter’s best efforts to contact the prize winners or deliver a prize, if a prize remains unclaimed by 27th March 2020 then, subject to any written directions given by a relevant lotteries or gaming authority the Promoter may conduct an unclaimed prize draw at the same time and place as the original prize draw on that date to distribute the unclaimed prize. The first valid entry drawn will win the unclaimed prize. The winners of the unclaimed prize draw will be notified by email 48 hours after the draw.


PRIZE

The prize is $500 worth of Teva shoes for 2 winners to use online at au.teva.com. The prize can be used for any available styles on au.teva.com up to the total value of AU$500 RRP for each prize. Order to be made via email to the Teva team. The Purchase can be made from 27th February 2020 to 27th February 2021. Winners must be 18+ and meet the specifications in Condition 1.1.

The prize is not transferable, exchangeable or redeemable for cash. All elements of the prize are subject to availability.

If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant regulatory authority), to cancel, terminate, modify or suspend the Promotion, no refunds will be issued.


PRIVACY AND COPYRIGHT

By entering the competition, the prize winners agrees to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.

By entering the promotion and forming a database the entrant consents to receive emails regarding the promotion from the Promoter and other emails which inform the entrant of the Promoter’s promotions, products, and events. Participants will have the option to unsubscribe to communications by Teva Australia should they choose at any point.

The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.


DISCLAIMER AND INDEMNITY

To the extent permitted at law, the Company and its related entities, officers, employees, contractors and agents disclaim any liability of any kind (including in contract, tort and breach of statutory duty) for loss, personal injury, death, property damage or otherwise that you may suffer yourself or cause to other persons or property as a result of any activities related to the prize that you undertake or commence, whether inspired by the Promoter or its related entities, officers, employees, contractors and agents, or otherwise.

The prize winners acknowledge their personal responsibility and knowingly and willingly assume the risks of associated with any activities related to the prize. The Promoter does not condone or encourage in any way the consumption of alcohol or use of illicit narcotics.

The prize winners agree to indemnify, defend and hold harmless the Promoter and its related entities and officers for any and all claims, demands, suits, loss, damage, injury, and liability, including costs, expenses, and reasonable solicitors fees arising from, or in any way connected with, the prize.

Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.
